Important Note: Selling Stolen Property is a Criminal Offense

🚨 Legal Framework in India

The following provisions of Indian law deal with stolen property and fraudulent transactions:

Indian Penal Code (IPC), 1860

  • Section 378 & 379 – Theft: Anyone committing theft shall be punished with imprisonment up to 3 years, or fine, or both.
  • Section 410 – Stolen Property: Any property obtained by theft, extortion, or robbery is legally classified as stolen property.
  • Section 411 – Dishonestly Receiving Stolen Property: Whoever knowingly or unknowingly tries to sell stolen property is punishable with imprisonment up to 3 years, fine, or both.
  • Section 414 – Assisting in Concealing or Disposing Stolen Property: Even helping in selling or concealing stolen property is punishable under law.

Code of Criminal Procedure (CrPC), 1973

  • Offenses related to stolen property are cognizable offenses, meaning the police can register an FIR and arrest without a warrant.

Prevention of Money Laundering Act (PMLA), 2002

  • Selling stolen valuables for money may be treated as money laundering, which carries imprisonment up to 7 years along with fines.

Indian Contract Act, 1872

  • Any contract (transaction) involving stolen goods is considered void and illegal, offering no protection to the seller.

  4. Customer Declaration – You must declare that the items you sell are your own lawful property.
  5. Zero-Tolerance Policy – If any item is suspected to be stolen or unlawfully acquired, we will:
  • Immediately refuse the transaction
  • Retain the item temporarily as per legal norms
  • Inform local police authorities for investigation
